1. KEY PRINCIPLES

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OR REQUESTING THE SERVICES MADE AVAILABLE TO YOU VIA BEST TRANSFER’S WEBSITE AS THEY INCLUDE A BINDING ARBITRATION CLAUSE (IN SECTION VIII), IMPORTANT INFORMATION ABOUT THE SERVICES, YOUR RIGHTS AND OTHER IMPORTANT INFORMATION.

These Terms apply to transferna’s website in Switzerland.
By using transferna‘s Website Services you accept these terms and conditions.

transferna may change these Terms from time to time. We will inform you of changes within a reasonable time period. You will be bound by such changes upon their notification to you in transferna’s Website Services or by email.

Please remember to check these Terms before you use the transferna‘s Website Services, as the latest set of Terms will apply in each case.

The invalidity of any provisions in these Terms does not affect the validity and enforceability of the rest of these Terms. Any such invalid, illegal or unenforceable provisions shall be deemed deleted.

We may assign, subcontract or transfer these Terms or any of our rights or obligations in them, in whole or in part, without your prior consent, provided this will not lead to a reduction of the rights you are entitled to by virtue of these Terms or by law. We will tell you if this happens. You may not assign, subcontract or transfer these Terms or any of our rights or obligations, in whole or in part, as your use of the transferna‘s Website Services is personal, unless agreed otherwise.

transferna collects, uses and discloses information from or about you as described in transferna’s Privacy Notice.

If you make a request through transferna’s website, you agree to pay the relevant charges as described on transferna’s website.

Depending on the transferna‘s Services used, including, but not limited to, its location, the charges may be displayed on transferna‘s website before a request is placed.

You may be charged supplementary charges, costs and/or fines, for your use or misuse of transferna Provided Services (such as repair or cleaning fees).
In some cases, if the transferna Provided Services cannot be performed due to your action or inaction (for example, if you are not present at the pick-up) all charges may apply.

The charges may be modified in transferna‘s website from time to time.
The charges do not include tips. You may pay tips in person.

Unless otherwise agreed, all charges are due immediately upon a request being placed and payment will be facilitated by transferna using the preferred payment method, after which transferna will send you a receipt by email. If your primary payment method is not able to be charged, transferna may use a secondary payment method if available. If your payment method(s) are unavailable, we reserve the right to continue to try to take payment.

Charges are inclusive of applicable taxes including VAT /TVA/ unless specifically stated otherwise.

Our accepted payment methods are set out on our Website. When you make a Booking request, transferna may need to verify your payment method by issuing a temporary authorization hold from your bank.

Your right to cancel a Contract depends on when you decide to end the Contract in this case our Cancellation Policy apply. If transferna is not at fault, and you do not have a right to change your mind, you can still end your Contract, but any money you have paid in advance are not subject to return in accordance with our cancellation policy. transferna will make refunds due to you as soon as possible, where applicable.

transferna may end your Contract in certain circumstances, as provided for in these Terms. If transferna ends the Contract when in fault, transferna will refund any money you have paid in advance.

If there is a problem with transferna‘s Transportation Services, or if you have a complaint, please contact us on the details set out in the ‘About Us’ section above.

1. CANCELLATION BY YOU

Cancelling the use of an ordered transport service is considered to be the situation where the driver has replied to your request and you subsequently reject, cancel or refuse the transport service.

Standard cancellation requests must be received, in writing, at our email address info@transferna.ch minimum of 48 hours before the scheduled transfer to be eligible for refund.

Cancellations requested less than 48 hours prior to the scheduled transfer must be communicated to our email info@transferna.ch and any money you paid in advance are NOT subject to return.

Eligible refunds for cancellations will be processed using the same method of payment used at the time of purchase.

2. CANCELLATION BY US

There may be rare instances in which we need to cancel your booking due to transferna unavailability or other unforeseen circumstances. In these cases, we will inform you of your cancellation as soon as possible and issue an immediate and full refund for the service not provided. We will not, however, be liable for any further costs that may arise from the cancellation of your service.

transferna may refuse requests and cancel the transferna Provided Services if there is reasonable doubt about the correctness or authenticity of the request or about the contact information.

When driver notifies the passenger about the arrival of the vehicle to its destination and passenger or people for whom the transport was ordered do not arrive at the vehicle within certain time period as specified in the transferna‘s Website, the request will be deemed cancelled and any money you paid in advanced are not subject to return.

3. FORCE MAJEURE

transferna cannot guarantee or be held responsible for extraordinary situations that may occur before or during your transfer. Such circumstances may include, but are not limited to, accidents and related delays, traffic, controls or police activity, acts of vandalism or terrorism, protests and organized disturbances, unforeseen hazards on the roadway, acts of government or national authority, natural disasters, fire and adverse weather conditions or other events beyond the control of transferna.

You are free at all times to use the transferna’s Website Services (where and when available) complying with these Terms and conditions.

We may terminate these Terms and your access to the transferna‘s Website Services with immediate effect if we conclude that there is a breach by you of these Terms.

transferna may, in its sole discretion, terminate these Terms or discontinue the transferna‘s Website Services at any time by giving you reasonable advance notice in writing.

If we cannot charge the relevant charges to your preferred payment method, we may suspend or remove your access to the transferna‘s Website Services until payment is made.

You are liable for any damage suffered by us as a result of your violation of these Terms, your misuse of the transferna’s Website Services or your violation of any laws. You are liable for all activities conducted through your e-mail at the time of booking process unless such activities are not authorized by you and you are not otherwise negligent.

In order to have access to the transferna‘s Website Services, you agree to indemnify, defend (at our option) and hold us and our respective employees harmless from and against all claims, liabilities, expenses, damages, penalties, fines, social security contributions and taxes arising out of or related to a breach of these Terms, breach of applicable law or third party claims directly or indirectly related to your use of the transferna‘s Website Services generally.

In the event that transferna would have to face a financial penalty as a result of the failure of a passenger to comply with local laws, regulations or other requirements imposed by Switzerland we reserve the right to withhold service or any money paid to us until the full sum of the penalization is paid.

In the event of a dispute, we both parties (transferna and you as a the client) agree to attempt in good faith to resolve any such dispute arising out of or relating to these Terms and Conditions by negotiation.

You could raise a complaint using the contact details in the ‘About Us’ section above. In the unlikely event that we cannot resolve the dispute within thirty (30) calendar days of a request from both sides for negotiation, either party may initiate arbitration only as provided in the next Section (VIII).

We both (transferna and you as a the client) agree to Arbitrate.

Any dispute or claim relating in any way to your use of transferna’s services will be resolved through final and binding arbitration, rather than in court.

There is no judge or jury in arbitration and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the  same damages and relief as a court, and must follow these Terms and conditions as a court would.

If you are a resident of Switzerland, you also agree to the mandatory arbitration provisions above.

The arbitration process will have the following characteristics:

By accessing and using the transferna’s Website Services you accept these Terms.

transferna’s Website can be accessed on most modern mobile devices with an internet connection and equipped with popular operating systems such as Android or iOS.

You are responsible for obtaining the network access necessary to use the transferna‘s Website Services and are responsible for any rates and fees from your mobile network provider, including from data consumption while using transferna‘s Website. You are also responsible for obtaining compatible devices and operating systems necessary to use the transferna‘s Website Services, including any software or hardware updates.

To use the transferna‘s Website Services in the Switzerland, you must register in transferna‘s Website using your e-mail and you must be eighteen (18) or older.

You must provide us with certain personal information to register your booking, including your phone number and email address. To use the transferna’s Website Services, you may need to provide at least one valid payment method (that is, a credit card, debit card or any other accepted payment method). You may need to provide additional information and documents before using transferna’s Website Services, such as your address.
You are under no obligation to log in to, or use, transferna‘s Website.
If you choose to stop using transferna‘s Website, you may do so without giving us any notice.

transferna may temporarily restrict your access to and use of the transferna’s Website Services if there is a suspected breach of your obligations or otherwise of these Terms, including where we receive a complaint in relation to fraud. There may be circumstances in which we are unable to provide you with information about the complaint whilst an investigation is ongoing (by us and/or a third party such as the police).

When using the transferna’s Website Services, you must comply with all applicable laws. You may only use transferna’s Website Services for lawful purposes and for the purposes for which they were intended as otherwise referenced in these Terms. You must not misuse transferna’s Website or attempt to defraud.

You must provide accurate and complete information when you register a booking and when using the transferna’s Website Services.

You will be responsible for paying any fees or charges that may be incurred as a result of the provision of transferna‘s Website Services requested through your e-mail.

You must not, in your use of the transferna‘s Website Services, cause any nuisance, annoyance, inconvenience, or property damage to transferna.

You will not be charged for using the transferna‘s Website Services. However, we reserve the right to introduce a usage charge, in which case you will be informed in writing and given the opportunity to terminate these Terms before any such charge is introduced. If you choose to terminate these Terms, you will no longer be able to access or use the transferna Website Services.

We reserve the right to introduce a fee, and we will inform you, for specific features on transferna‘s Website Services, in which case you can decide if you wish to proceed. These may be subject to separate terms, which transferna will make available to you at the time.

If there is a problem with the transferna’s Website Services, or if you have a complaint, please contact us on the details set out in the ‘About Us’ section above.

1. CONTRACT

A request for a Booking constitutes an offer by you to purchase transferna’s Transportation Services in accordance with these Terms. This Booking request will set out the main characteristics of the transferna’s Transportation Services (including pick up and drop off points). Your offer shall only be accepted when transferna issues written confirmation of the relevant transferna’s Transportation Services via email at which point and on which date and time a contract for transferna’s Transportation Services to which the Booking relates shall come into existence (‘Contract’).

There is no obligation on us to accept a Booking and it may be declined for any reason. ​​If a driver becomes unavailable after we have provided you with written confirmation of the Contract, we will endeavor to find you another driver for your Booking. Where an alternative driver cannot be found, we reserve the right to terminate the Contract without compensation to you.

We will inform you of the estimated time of driver arrival and estimated time of journey completion, but these are estimates only and time shall not be of the essence. If we cannot accept your Booking request, we will inform you of this and will not charge you for transferna‘s Transportation Services.
Your Contract will end when the passenger journey ends or as otherwise may be provided for in these Terms.

It is the client’s responsibility to review and ensure that all names, addresses, telephone numbers, dates, hours and other information provided are correct. If any information provided be incorrect, you must contact us immediately and never less than 24 hours before your scheduled service.

The price for the Contract (which will include VAT /TVA/, if applicable) will be provided to you via transferna’s Website Services before you place your Booking request. This may include relevant surcharges (including airport pickup, drop off, tunnel tolls, parking or other airport charges) and/or tolls, road charging schemes, charges for low emission or similar zones, and road tax. You may be charged a different amount than the price provided in certain situations, including but not limited to, material changes to the pick/up drop off point, route taken, driver waiting time, stops or traffic. In this situation, the rates that will apply will be available to you via transferna’s Website Services. These may be modified or updated from time to time. It is your responsibility to remain informed about the current rates for transportation services.

Additional charges may also apply, for instance if you, or any passenger, soils, contaminates, or damages a vehicle, in which case you may be charged for such damage, as well as for a cleaning fee.

Passengers will be collected at the meeting point, date and time specified on the booking confirmation email. The driver will wait for a maximum of 60 minutes after the arrival of your flight at the airport and a maximum of 10 minutes at all other meeting points. If your group is not present at the meeting point at the agreed-upon time, you will lose all rights to reimbursement for the transfer.

In the event that you are unable to locate the driver, it is your responsibility to contact transferna at the 24h Assistance number on the website.

All phone calls received to our office and 24h Assistance Telephone number are registered and logged by a third-party telecommunications provider and shall be used in the case of any dispute as to whether an attempt to contact us was made.

If the customer fails to call this number and transferna is not made aware of the problem, the transfer will be cancelled and no refund will be due.

During the booking process you must indicate to us if you are travelling with children. Depending on the country in which you are travelling the laws with respect to child restraint systems differ. As such, we recommend that you bring with you the restraint system with which you are most familiar. If you do not wish to travel with your own child restraint system, you may request one provided by transferna during the booking process.

The mark and the model of the vehicle reserved may be changed to another of similar or superior characteristics regarding size and quality depending on Supplier availability. In the case that the vehicle used is of a larger or higher category than that originally reserved you will not be obliged to make any additional payment.

2. LUGGAGE

Our standard luggage allowance permits each passenger one bag with combined dimensions of 140cm (height + width + length). However, it will be your sole responsibility to ensure that you select and reserve a vehicle large enough to accommodate all passengers, luggage and any other extras reserved.

If you are unsure of which vehicle to reserve, please contact us on the details set out in the ‘About Us’ section above.

If you forget an item of luggage in the vehicle we will make all reasonable efforts to recover the item lost and if available, we will arrange shipment to the address provided during the booking. You will be responsible for covering all additional costs, including shipment and transferring of the lost item.

transferna recommend that you do not carry in your luggage any fragile or valuable objects such as jewelery money, cheques or other valuable documents such as passports or identity cards.

transferna will NOT be held responsible for any loss or damages that your luggage may suffer. We recommend that you contract a travel insurance policy that can cover any loss or damage.

In accepting these terms and conditions you are obliged at all times to comply with the local laws and legislations where your transfer takes place. Accordingly, your luggage may not contain any articles prohibited by local law or legislation.

During the booking process, you must make it known to us if you are travelling with any domesticated animals. Pets are the sole responsibility of their owner and must, at all times, travel in an IATA-approved crate. Transporting pets is subject to availability and approval of transferna and an additional charge will be applied. If we are not informed at the time of booking that you will be travelling with a pet or if the above requirements are not met transferna reserves the right to refuse service and your transfer will be cancelled without refund.

Any requested change to your booking must be sent to us in writing to the following email address: info@transferna.ch

All modifications are subject to approval by transferna, confirmation of which will be sent to the email address provided at the time of booking.
Modifications, subject to the conditions outlined above, are allowed up to 24 hours before your first scheduled transfer.

You will be responsible for any increased costs incurred in the requested service as a result of any modification to your booking. Increased costs may result from changing: the size of a vehicle, your destination, extras, etc. You will be informed of any increased costs in the service via email which will include a link where payment can be made.

If a requested modification to your booking results in a reduction of the price of your requested service, you will be reimbursed the difference if your modification request is received a minimum of 24 hours before your first scheduled transfer.

transferna will be monitoring your flight arrival time according to the information provided to us during the booking process. However, if your flight is delayed by 3 hours or more, your flight number changes, you miss your flight or if your flight is cancelled, you must inform us by writing an email to info@transferna.ch

Any resulting modification to your transfer details, including collection time, is subject to acceptance by transferna.

Once your plane has landed, our driver will wait a maximum of 60 minutes at the meeting point indicated in your booking confirmation email. If you feel that your group may take longer than 60 minutes to arrive at the meeting point (due to passport control, customs, baggage claim, lost baggage, etc.) please send someone from your group to the meeting point to inform the driver of any delays.

If the driver is required to wait past 60 minutes, this will be subject to availability and your transfer may be subject to an additional charge. If the driver has not been advised of any delays and no member of your group has arrived at the meeting point 60 minutes after the arrival of your flight, the service will be cancelled and payment forfeited.

In meeting points other than airports the driver will wait a maximum of 10 minutes for your group to arrive.

All communication with you will be made through email. As such, we recommend that you always check your email before you travel to ensure that no important changes have been made to your booking. All notifications will be sent to the email address provided to us at the time of booking.

If your email address or contact telephone number change, you must provide us with your new contact information immediately so that we may contact you for any issues related to your booking.

In the event that you are not present at the meeting point described in your Reservation 60 minutes after your flight has landed (in the case of collection at airport) or 10 minutes after your scheduled pick-up time (in the case of transfers to the airport), transferna will try to contact you at the telephone number provided to us during the booking process.

If transferna cannot reach you because you do not answer the call, your telephone has no service, the call is sent directly to an answering service or because the connection fails, the service will be considered cancelled without reimbursement.
